The detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has urged the Federal High Court in Abuja to postpone its planned November 20 judgment in the terrorism charges filed against him by the Federal Government.
In a fresh motion filed through his legal team led by Mike Ozekhome (SAN), Kanu argued that proceeding with judgment while several pending applications on his bail and alleged rights violations remain unresolved would amount to a miscarriage of justice.
The IPOB leader maintained that the court must first determine his request to be transferred from the custody of the Department of State Services (DSS) to house arrest or correctional facility, to allow him adequate access to his lawyers for a fair defence.
Kanu also claimed that his continued detention contravenes previous rulings by appellate courts, which quashed some of the terrorism-related counts and ordered his release, a decision the government has yet to comply with.
The case, which has drawn both local and international attention, is expected to resume next week for the court’s decision on whether to proceed with the scheduled judgment or defer it pending the outcome of the new motion.
