N400bn probe: El-Rufai gets fresh trial in rights suit
The Court of Appeal has ordered a fresh hearing in the fundamental rights suit filed by former Kaduna State Governor, Nasir El-Rufai, in connection with investigations into an alleged ₦400 billion probe.
In its ruling, the appellate court held that there were concerns relating to the observance of fair hearing during earlier proceedings, thereby necessitating a retrial before a different judge. The court emphasised that the constitutional right of litigants to adequate hearing must be upheld in all judicial processes.
El-Rufai had approached the court to challenge aspects of the investigation and actions taken by relevant authorities, arguing that his rights were violated. The suit forms part of ongoing legal disputes arising from inquiries into financial transactions and administrative decisions taken during his tenure as governor.
Legal representatives for the parties are expected to prepare for the fresh proceedings, which observers say could shape the direction of the broader case and clarify issues relating to due process.
Analysts note that the appellate court’s decision underscores the judiciary’s role in safeguarding constitutional rights while ensuring that allegations of financial misconduct are properly examined within the framework of the law.
