A Federal Capital Territory High Court in Abuja has upheld the continued detention of former Attorney-General of the Federation and Minister of Justice, Abubakar Malami (SAN), by the Economic and Financial Crimes Commission (EFCC).
Justice Babangida Hassan, on Thursday, dismissed a bail application filed by Malami challenging his detention by the anti-graft agency. The ruling was delivered on December 18, 2025.
According to EFCC spokesperson, Dele Oyewale, Malami, through his counsel, Suliaman Hassan (SAN), had argued that his detention during an ongoing investigation was unlawful and violated his rights.
However, EFCCโs counsel, J. S. Okutepa (SAN), maintained that the former minister was being held based on a valid remand order previously issued by the FCT High Court and granted by Justice S. C. Oriji.
Justice Hassan, referencing Section 35 of the 1999 Constitution (as amended), stated that the Administration of Criminal Justice Act allows lawful detention under a court-issued remand order.
The judge added that granting the bail application would amount to sitting in appeal over a decision of a court of coordinate jurisdiction, which is beyond his power.
Malamiโs detention will therefore continue while the EFCC proceeds with its investigation.
